Do my Indian mutual funds need Form 8621?

If you were a U.S. person for the year, your Indian mutual fund schemes are generally treated as PFICs, and Form 8621 is generally filed once per scheme — unless a small-holdings exception may apply. Whether you were a U.S. person depends on a green card or the days you spent in the U.S., not on the visa. If your return is already filed without the forms, it is corrected, usually with Form 1040-X.

Up to nine short screens: your status for the year, your funds in ranges, and what was already filed. The result maps what applies, what may not, and what needs a professional — and, if you want it handled, asks for a fully managed quote without making you repeat anything. Holding funds from somewhere else? The PFIC assessment goes fund by fund.

Check your Indian mutual funds

Your U.S. status for the year, your funds in ranges, and what was already filed. No statements, no account numbers, no exact figures — "not sure" is a fine answer. The result shows whether Form 8621 is likely, whether an exception may apply, and whether a filed return needs correcting.

What the assessment looks at

Whether the PFIC rules reach you
Your U.S. status for the year, from the green card and substantial presence tests — never from the visa alone.
Whether Form 8621 is likely
One per scheme that is a PFIC; whether the small-holdings exception may apply on your values and activity.
Redemptions, switches and payouts
Which ones are dispositions or distributions that change what has to be calculated.
What was already filed
Whether a filed return needs correcting — usually Form 1040-X — and the earlier years.
FBAR and Form 8938
Folios and NRE/NRO accounts as foreign accounts; the in-U.S. Form 8938 thresholds.

Who it is for

U.S. residents and citizens who still hold mutual funds in India — including people who already filed and only now heard about Form 8621.

What it does not do

It does not decide residency for a borderline year, classify each scheme, calculate tax, or file anything. It screens from ranges, says what is likely and what may not apply, and routes the open points to review.

If you want it handled

One quote, the professional's fee included

A qualified CPA or enrolled agent Atamatax engages for your case prepares the returns and forms your quote lists; Atamatax collects the documents and coordinates the case. The professional is named on your case once assigned — never before.

As your written quote names it: e-filed through the engaged professional's authorised e-file provider where the year and forms allow it, otherwise a paper filing Atamatax coordinates for you to sign. Atamatax's own software transmits nothing; a filing is recorded on your case only with its confirmation.

Always scoped first, free: a person reads the facts, a professional accepts the case and states their fee to Atamatax, and you receive one written quote from Atamatax that includes it — before any payment for the full engagement. An initial scoping stage, where one is offered, is priced on its own and credited in full. You never contract with or pay the professional separately.

Questions people ask

I'm on an H-1B. Do the PFIC rules apply to me?

They apply to U.S. persons, and someone on an H-1B usually becomes a U.S. resident through the substantial presence test — 31 days in the year and 183 weighted days — not through the visa itself. The arrival year can be split into a nonresident part and a resident part. The check asks the facts the tests use and flags a borderline year for review.

Do I need one Form 8621 for every fund?

Generally one per PFIC — per scheme — not one per folio and not one per SIP instalment. SIP instalments are separate purchase lots reported on the same scheme's form. And in a year with no redemptions or excess distributions, the small-holdings exception (aggregate PFIC value of $25,000 or less on the last day of the year ($50,000 MFJ)) may mean no form at all.

I already filed my return without Form 8621. Is it too late?

No — a filed return is corrected, not abandoned. The usual route is a Form 1040-X with the Forms 8621 attached, and the tax on any redemptions recomputed. An omitted Form 8621 on its own is not automatically a Streamlined case.

I filed an FBAR. Aren't my Indian investments already reported?

The FBAR reports the accounts — a folio held with an Indian fund house counts as one. It does not report the funds for PFIC purposes; Form 8621 is a separate form filed with the tax return.

What happens to my answers?

They stay ranges and choices — no statements, account numbers or amounts. They are kept only if you save the check or ask for a quote, and they are never sent to analytics. If you ask for a professional quote, Atamatax reads them so you are not asked again.
