Terms of Service

These Terms govern your use of the Atamatax tax-filing service at atamatax.com(the "Service") operated by Atamatax LLC. By creating an account or using the Service you agree to these Terms.

What we are (and what we are not)

Atamatax is a software preparer in the same category as TurboTax. We generate IRS-compliant forms from the inputs you provide and transmit them to the IRS Modernized e-File (MeF) system and FinCEN BSA through approved intermediaries.

Atamatax is not a CPA firm, a tax attorney, a financial advisor, or a registered investment adviser. We do not provide individualized tax, legal, or financial advice. For situations the Service cannot handle (entities, trusts, IRS examinations, etc.) we may refer you to a partner CPA but the retainer is between you and the CPA.

Eligibility & accuracy of inputs

You must be at least 18 years old and either a US citizen or US green-card holder. You are responsible for the accuracy and completeness of every number, election, and attestation you give us. The Service will sometimes auto-fill values (e.g. PFIC classification from ISIN, holdings from Plaid). Those auto-fills are suggestions derived from external data sources and you are responsible for reviewing and confirming them before you authorize e-filing.

Plaid & brokerage data

You can authorize Atamatax to import your brokerage holdings and transactions through Plaid. By doing so you also agree to Plaid's End User Privacy Policy and Plaid's End User Terms. You can revoke that authorization at any time from your brokerage portal or by emailing us; revocation does not remove the data we already imported, only the future ability to refresh.

Payment

Atamatax is free until you e-file. When you choose to file, you authorize a one-time charge in US dollars through Stripe (Simple $299, PFIC $499, Complex $799). Charges are non-refundable once the IRS has accepted the return. If the IRS rejects the return, we resubmit at no additional cost; if the rejection is permanent we refund 100%.

No tax advice

The educational copy on Atamatax pages, including treaty desk summaries, PFIC method descriptions, and FAQ entries, is general information about US tax rules. It is not a substitute for advice from a licensed CPA, enrolled agent, or tax attorney. Tax rules change. We will update the Service in good faith but cannot guarantee continuous accuracy.

Disclaimer of warranties

The Service is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted or error-free. You use the Service at your own risk.

Limitation of liability

To the maximum extent permitted by law, Atamatax LLC's total liability to you for any claim arising out of or relating to the Service is limited to the amount you paid us in the twelve months preceding the claim. We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, data, or goodwill.

We are never liable for the underlying tax treatment of your facts — that is determined by the IRS and tax law, not by our software. Penalties or interest assessed by the IRS against you are your responsibility unless we can prove the assessment resulted from a software defect in a generated form.

Indemnification

You agree to indemnify and hold Atamatax LLC, its officers, employees, and contractors harmless from any claim arising out of (a) inputs you provided that turned out to be false, (b) activity on your account by someone you authorized, or (c) your violation of these Terms or applicable law.

Account closure

You can close your account at any time by emailing support@atamatax.com from the address on file. We retain filed returns and related data for 7 years after the relevant tax year (IRS standard). Active credentials and tokens are revoked and deleted within 90 days of account closure.

We may suspend or terminate accounts that we reasonably believe to be fraudulent, are being used to file inaccurate returns, or breach these Terms.

Changes to these Terms

We may update these Terms. Material changes take effect 14 days after we email registered users about them. Continued use after that date is acceptance.

Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Disputes shall be resolved exclusively in the state or federal courts located in New Castle County, Delaware, and you consent to that personal jurisdiction. Nothing in this section prevents either party from seeking injunctive relief in any court of competent jurisdiction.
