When a professional's judgment is needed. An open IRS examination, a question about whether the missed years were willful, or an unsettled US status goes to a person before anything is quoted — those decide whether a catch-up procedure is available at all, and nothing should be certified under penalty of perjury until they are answered. Most IRS letters do not close a route; an examination does.

Questions people ask

I haven't filed U.S. taxes for years. What should I do first?

Establish which years actually needed a return and which forms were involved, before choosing a route. Income below the filing threshold can mean no return was due for a year; foreign accounts, funds, companies or gifts can add information returns. Then the route — late filing, amended returns, or a Streamlined procedure — is chosen with a professional.

Can I use the Streamlined Foreign Offshore Procedures?

They are for U.S. persons who meet the non-residency test (no U.S. home and 330 full days outside the U.S.) in at least one of the last three years, whose failure was non-willful. A submission includes the most recent 3 years of returns and the most recent 6 years of FBARs. They can be used once, and not by someone under IRS examination or criminal investigation.

Do I need to file old FBARs?

If all your foreign accounts together exceeded $10,000 at any point in a year, an FBAR was due for that year. When the income was reported and only the FBARs are missing, they are filed late with the reason and a reasonable-cause statement. The IRS withdrew its published Delinquent FBAR Submission Procedures page on July 1, 2026; the examiner standard in IRM 4.26.16 is unchanged.

Do you ask whether I was non-willful?

No. Non-willfulness is a legal characterisation certified under penalty of perjury. The assessment asks what happened — whether you knew about the requirement, whether someone handled it — and leaves the characterisation to a professional.

The IRS has already contacted me. Can I still use this?

Yes, but the result changes. Most letters do not close any route; an examination or investigation does, and then the right first step is a tax attorney — the assessment says so instead of suggesting a do-it-yourself procedure.
